A prenup is used to regulate the property if you are married and want a different distribution than “Community of property” (the legal basic distribution). A Cohabitation/Collective agreement is used by unmarried couples who own a property together and want to regulate the joint ownership.
Why get a Cohabitation/Collective agreement?
If you own a house, an apartment or a vacation home with other parties, you should get a Cohabitation/Coleective agreement. It will regulate what will happen if one party does not pay the running expenses, if someone passes away, or if someone wants to sell. All commitments are solidary so it can get very expensive if the terms are not agreed in writing.
Why get a Prenuptial agreement?
If you want partly separation of property or an evenly distribution of pensions funds you will a need prenup. Thus is also the case if there are any special requirements regarding the house or apartment in case of divorce or death.
